- (2) Matters not provided for in these Terms and Conditions shall be governed by applicable laws and regulations or generally established customs.
Article 2 Establishment of Use Contract
- (1) A contract for the use of a Restaurant (the "Use Contract") shall be established when the Hotel accepts a reservation application from a Customer or, where no reservation is made, when the Customer arrives and the Hotel accepts the Customer's use of the Restaurant.
- (2) The Hotel may require an advance reservation in the manner prescribed by the Hotel for course meals, private rooms, group dining, special menus, or other use requiring special preparation.
- (3) When a reservation application is made, the Hotel may confirm the purpose of use, number of customers, requested arrangements, and other necessary information.
Article 3 Hours and Conditions of Operation
- (1) The hours of operation, offerings, prices, and other operating conditions of the Restaurants shall be as separately determined by the Hotel.
- (2) The Hotel may change the hours of operation, offerings, prices, or other operating conditions due to seasonal factors, procurement conditions, private functions, equipment inspections, or other reasons.
- (3) If a Customer occupies a table for an extended period without the Hotel's approval and this interferes with use by other customers or Restaurant operations, the Hotel may request an adjustment to the Customer's use time or ask the Customer to leave the Restaurant.
Article 4 Reservation Changes and Cancellations
- (1) A Customer wishing to change or cancel a reservation must promptly notify the Hotel.
- (2) A cancellation communicated by the Customer on the day of the reserved visit shall be treated as a same-day cancellation.
- (3) If a Customer does not arrive within 30 minutes after the reservation time without prior notice and does not respond to contact from the Hotel, the reservation shall be treated as a no-show cancellation.
- (4) Depending on the reservation details, the Hotel may charge the following cancellation fees:
- Cancellation Fees
- General Reservations
- • Up to the day before use: No charge
- • Same-day cancellation: 100% of the reserved food charges
- • No-show cancellation: 100% of the reserved food charges

- • Two days before use through the day before use: 50% of the reserved food charges
- • Same-day cancellation: 100% of the reserved food charges
- • No-show cancellation: 100% of the reserved food charges
- (5) If the menu has not been determined, the cancellation fee shall be calculated on the basis of the minimum course price or minimum usage charge separately prescribed by the Hotel for the reservation, or the reference amount notified at the time of booking.
- (6) In addition to the amounts specified in the preceding paragraphs, the Hotel may charge actual expenses for food, beverages, floral arrangements, gifts, or other items that have already been ordered, produced, or otherwise arranged.
- (7) The total cancellation fees and actual expenses charged under the preceding paragraphs shall not exceed the amount of loss actually incurred by the Hotel.
- (8) If separate cancellation conditions are displayed or communicated for a plan, special menu, reservation made through a booking website, or other reservation, those conditions shall take precedence.
Article 5 Group Reservations
- (1) The Hotel may establish separate conditions for reservations of 10 or more customers and treat them as group reservations.
- (2) For a group reservation, the Hotel may apply conditions different from those for an ordinary reservation regarding the deadline for confirming attendance, menu, seating arrangement, private room charges, cancellation conditions, and other matters.
- (3) If the number of customers decreases after attendance has been confirmed, the Hotel may charge for the confirmed number of customers.
Article 6 Outside Food and Beverages
- (1) Food and beverages may not be brought into a Restaurant without the Hotel's approval.
- (2) Notwithstanding the preceding paragraph, if the Hotel individually approves an item to be brought in, a charge for bringing in the item or other conditions prescribed by the Hotel may apply.
- (3) The Customer shall be responsible for hygiene management, quality control, and all other consequences arising from any item brought in, and the Hotel shall not be liable for such consequences.
Article 7 Food Allergy Accommodation
- (1) The Hotel places the highest priority on customer safety. As a general rule, customers with food allergies will be accommodated using a low-allergen menu established in advance by the Hotel or by substituting a low-allergen dish.
- (2) As a general rule, the Hotel does not accept requests for the individual removal, modification, or substitution of ingredients or other customized accommodation.
- (3) Food allergy information must be provided no later than four days before the date of use. For requests made on the day of use, the Hotel is unable to substitute a low-allergen dish, remove ingredients, or provide other special accommodation. In such case, the Hotel will provide the allergen information it has confirmed for each dish, and the Customer shall decide whether to consume the dish after considering that information.
- (4) Because food is prepared in a shared kitchen using shared cooking utensils, washing facilities, and other equipment, the possibility of trace allergen cross-contact cannot be completely eliminated.
- (5) If severe symptoms, including anaphylaxis, may reasonably be anticipated, the Hotel may, in the interest of customer safety, decline to provide Restaurant services at its discretion.
- (6) Customers are requested to make the final decision regarding use of the Restaurant after considering the contents of the low-allergen menu or dish established and explained by the Hotel and the possibility of trace allergen cross-contact described in Paragraph 4.
Article 8 Changes to Offerings
- (1) The Hotel may change menu items, beverages, tableware, methods of service, or other offerings due to ingredient availability, seasonal factors, legal requirements, or other unavoidable circumstances.

Article 9 Food Hygiene Management
- (1) For food hygiene reasons, the Hotel generally does not permit food or beverages served in a Restaurant to be taken away from the premises.

Article 11 Compensation for Loss or Damage
- (1) If the Customer, any person accompanying the Customer, or any person arranged by the Customer intentionally or negligently damages, soils, destroys, or loses any Hotel facility, equipment, fixture, or other property, or causes loss or damage to a third party, the Customer shall compensate for such loss or damage.
- (2) If the Customer suffers loss or damage due to a cause attributable to the Hotel, the Hotel's liability shall be limited to the total amount actually received from the Customer in connection with the relevant use.
- (3) The limitation in the preceding paragraph shall not apply where the Hotel has acted intentionally or with gross negligence.
Article 12 Refusal of Use and Termination of Use Contract

- 8. The Hotel otherwise reasonably determines that safe and orderly operation would be difficult.
- (2) Even if the Hotel terminates the Use Contract under the preceding paragraph, where the cause of termination is attributable to the Customer, the Hotel may claim any actual expenses, cancellation fees, or other losses already incurred.
Article 13 Prohibited Conduct
- (1) The following conduct is prohibited in connection with the use of a Restaurant:

- (2) If operation of a Restaurant or performance of a Use Contract becomes wholly or partially impossible due to force majeure, the Hotel shall not charge the cancellation fees specified in Article 4. However, the Hotel may charge actual expenses already incurred for the Use Contract.
Article 16 Handling of Personal Information
- (1) The Hotel shall appropriately handle personal information obtained in connection with reservation applications and use of the Restaurants in accordance with applicable laws and regulations and the Hotel's privacy policy.
Article 17 Governing Law and Exclusive Jurisdiction
